TERMS & CONDITIONS OF SEPHORA LOYALTY PROGRAM

1-PURPOSE OF THE LOYALTY PROGRAM

The SEPHORA loyalty program (the “Loyalty Program”) has been introduced by Sephora Middle East FZE, a free zone company duly incorporated under the laws of Dubai, United Arab Emirates, having its registered offices at PO Box 18536, Dubai, United Arab Emirates. The Loyalty Program is applicable only to Sephora stores in the United Arab Emirates, Kingdom of Saudi Arabia, State of Qatar, Kingdom of Bahrain and State of Kuwait (the “Sephora Stores”).

This Loyalty Program allows SEPHORA loyalty card holders to accumulate points on purchases made at Sephora Stores, entitling them to benefit from various offers and promotions.
There are three cards available as part of the Loyalty Program:

  • The SEPHORA White Card (part of the “White Card Program”)
  • The SEPHORA Black Card (part of the “Black Card Program”)
  • The SEPHORA Gold Card (part of the “Gold Card Program”)

 

2-SUBSCRIPTION TO THE LOYALTY PROGRAM

2.1 Eligibility for the Loyalty Program:

A customer who subscribes to the Loyalty Program (the “Loyal Customer”) will be offered a Sephora loyalty card. Points will accumulate on the loyalty card when products are purchased in Sephora Stores, and can be used to benefit from various offers.
Loyalty Cards are strictly reserved to customers who have a physical mailing address in the United Arab Emirates, Kingdom of Saudi Arabia, State of Qatar, Kingdom of Bahrain and State of Kuwait (the “Territory”).

Each customer is entitled to subscribe to one single Loyalty Program in the Territory. Sephora reserves the right to request at any time documentation to verify the identity of a customer who wishes to subscribe to a Loyalty Program.

All information disclosed by a customer must be complete, readable and usable to benefit from the Loyalty Program. Information disclosed must be kept up to date by being updated in-store, or by visiting the website loyalty.sephora-me.com. Sephora is not responsible for the non-receipt by a Loyal Customer of a loyalty card or an offer or promotion due to outdated or incorrect information.
Any voucher connected to this Loyalty Program which is damaged, scratched, torn or is in bad condition may be refused by Sephora at Sephora’s sole discretion.
In no event may any voucher be transferred or exchanged against cash.

2.2 Conditions for Obtaining the Sephora White Card:

The SEPHORA White Card is freely available to anyone upon request when making a purchase in a Sephora Store. To register for the Sephora White Card, customers must complete a registration form at a Sephora Store after which their card will be activated once forty eight (48) hours have passed.

2.3 Conditions for obtaining the Sephora Black Card:

A Sephora White Card holder will be sent to his/her mailing address a Sephora Black Card once he/she has accumulated two hundred (200) points on his/her Sephora White Card (hereinafter referred to as the “Eligible Loyal Customer”). Once the Eligible Loyal Customer has been upgraded to the Sephora Black Card, his/her Sephora White Card will automatically be replaced.

2.4 Conditions for obtaining the Sephora Gold Card:

A Sephora Black Card holder will be sent to his/her mailing address the Sephora Gold Card once he/she has accumulated one thousand five hundred (1,500) points on his/her Sephora Black Card while purchasing products in the Sephora Stores within a twelve (12) month period (hereinafter referred to as the “Eligible Gold Customer”). Once the Eligible Gold Customer has been upgraded to the Sephora Gold Card, his/her Sephora Black Card will automatically be replaced.

The validity period of the Sephora Gold Card will be specified on the Gold Card.

At the expiry of the validity period:

  • If the Loyal Customer has accumulated one thousand five hundred (1,500) points (10 AED/ 10 SAR/ 10 QAR/ 1BHD/ 0.8 KWD = 1 point) during the previous calendar year, the Sephora Gold Card will be automatically renewed for the following year;
  • If the Loyal Customer did not accumulate one thousand five hundred (1,500) points (10 AED/ 10 SAR/ 10 QAR/ 1BHD/ 0.8 KWD = 1 point) during the previous calendar year, the Loyal Customer shall receive a Sephora Black Card to replace his/her Sephora Gold Card and the points will be transferred onto the Sephora Black Card.

 

3-CONDITIONS OF USE OF THE LOYALTY PROGRAM

Loyalty Cards are personal to each card holder and cannot be transferred to or used by another person.

The benefits offered by a Loyalty Card can be taken advantage of only upon presentation of the Loyalty Card while purchasing products from Sephora Stores.

A Loyalty Card holder must use his/her Loyalty Card in strict compliance with these terms and conditions. If Sephora suspects that a Loyalty Card holder is not complying with these terms and conditions, it reserves the right to suspend or terminate the Loyalty Card at its sole discretion.

4-PERSONAL INFORMATION AND DATA

As part of the Loyalty Program subscription, Sephora will collect personal data about the subscribing Loyal Customer. This information will be used by Sephora in order to enable Sephora to provide the Loyalty Program, for example, in order to:

a) Keep track of the Loyal Customer’s purchase records;
b) Allocate points according to those purchase records;
c) Inform the Loyal Customer about promotions, news, brand offerings etc.;
d) Update Sephora’s profiling of the Loyal Customer’s preferences so that Sephora may tailor its products and services to better serve its customers throughout the Territory.

Sephora may from time to time, share such data with sub-contractors, consultants, agents and affiliated companies within the Territory for the purposes mentioned above. In this context, Sephora may also transfer such information outside the Territory for the purposes mentioned to the following:
a) Sephora’s employees;
b) Sephora’s sub-contractors, consultants, agents, and other providers who need to have access to the information in order to fulfill their obligations and deliver their services;
c) Sephora’s subsidiaries, sister companies and affiliated companies outside the Territory; and
d) Companies which belong to the Sephora Group and/or LVMH Group, and notably SEPHORA SAS in France.

Loyal Customers who wish to have access, amend or delete any data relating to him/her, may do so in-store, or by visiting the website loyalty.sephora-me.com.

Sephora may save any data collected from its Loyal Customers for a period of one hundred (100) years after the Loyal Customer’s record is first created in Sephora’s database records. However, if a person ceases to be a member of the Loyalty Program, Sephora may delete the data related to him/her from the database earlier.

Sephora shall be entitled to disclose any information or data collected from a Loyal Customer to the following entities:
a) Sephora’s lawyers for purposes of legal advice, settlement of dispute or litigation to protect Sephora’s interest;
b) Persons involved in collecting a debt owed by that customer/member to Sephora;
c) Persons identified in a Court subpoena in compliance with any Court subpoena;
d) Any government institution who has made a lawful request for such data;
e) To a statistician for scholarly or research purposes; or
f) Where such disclosure is required by law.

 

5-BENEFITS OF THE LOYALTY PROGRAM

5.1 Benefits for a White Card holder:

The White Card allows its holder to access the White Card Program and to earn and accumulate points while purchasing products in Sephora Stores.

Once activated, points will accumulate on the White Card when presented upon purchasing products in Sephora Stores. One point will accumulate for every:
- ten (10) United Arab Emirate Dirham (AED) spent on purchases in the United Arab Emirates
- ten (10) Saudi Riyals (SAR) spent on purchases in the Kingdom of Saudi Arabia
- ten (10) Qatari Riyals (QAR) spent on purchases in the State of Qatar 
- one (1) Bahraini Dinar (BHD) spent on purchases in the Kingdom of Bahrain
- zero point eight (0.8) (KWD) spent on purchases in the State of Kuwait

5.2 Benefits for accumulating points on a Black Card:

The Black Card allows its holder to access the Black Card Program and to earn and accumulate points while purchasing products in Sephora Stores.

Sephora Black Card holders will receive by mail their Black Card in a “Welcome Pack” along with a voucher equal to the two hundred (200) points accumulated on his/her White Card. The Loyal Customer will be entitled to redeem the voucher against one (1) gift from a selection made available by Sephora.

Afterwards, each time the Black Card holder accumulates a further two hundred (200) points, he/she will automatically receive a new voucher by email which can be redeemed against one (1) gift from a selection made available by Sephora. 
The gift selection is subject to stock availability.

5.3 Benefits for accumulating points on a Gold Card:

Customers eligible for the Sephora Gold Card will receive by courier their Gold Card in a “Welcome Pack”.

The Gold Card allows its holder to access the Gold Card Program and to earn and accumulate points while purchasing products in Sephora Stores.

Each time a Gold Card holder accumulates two hundred (200) points, he/she will automatically receive a new voucher by email which can be redeemed against one (1) gift from a selection made available by Sephora.

In addition to this, every time the loyal customer reaches a threshold of one thousand (1,000) points, he/she will automatically receive a voucher by email that he/she can redeem against one “VIP Privilege” from a selection of gifts made available by Sephora.
The gift selection is subject to stock availability.

Where any correspondence, Gold Card or voucher is to be mailed to a customer as part of the Gold Card Program, these will be sent only in cases where Sephora is able to contact the relevant customer to validate their delivery address and to schedule a delivery time.

5.4 Common provisions to both White Card Program, Black Card Program and Gold Card Program:

The points accumulated while purchasing products in the Sephora Stores cannot be transferred from the Loyal Customer to any other person nor can they be exchanged for cash.
In case of claim of reimbursement, Sephora reserves the right to deduct the points credited to the Loyalty Program card associated with the product in relation to which the reimbursement is requested.

The number of points accumulated on a Loyalty Card can be checked by the Loyalty Card holder:

  • By asking a cashier at a Sephora Store
  • At loyalty.sephora-me.com

 

Benefits offered to a Loyalty Card holder may vary depending on the information supplied by him or her due to the fact that some benefits can only be communicated via certain means (postal address, email or SMS).

During sales and promotional periods, the Loyal Customer can accumulate points but may not be permitted to redeem points on discounted merchandise.

6-COMMUNICATIONS

Loyalty Card holders will be sent news and special offers by mail, email or sms. In the event a Loyal Customer no longer wishes to receive such news and offers, he/she is entitled to unsubscribe on-line.

7-SEPHORA’S RIGHTS

Sephora may modify these terms and conditions at any time in its sole discretion. 
Sephora may inform the Loyal Customer of changes to these terms and conditions via mail, email or at loyalty.sephora-me.com. Loyalty Card holders should regularly check the website for the latest version these terms and conditions.

Sephora reserves the right to amend, suspend or terminate the Loyalty Program for any reason at any time. In the event that Sephora decides to terminate the Loyalty Program, all Loyal Customers will be informed by means of the contact information supplied by them. The Loyal Customer will then have thirty (30) days to redeem any benefits otherwise the accumulated points will be lost. In the event of termination and/or suspension of the Loyalty Program, Sephora will not be held liable for any unused points. Furthermore, the Loyal Customer will have no legal recourse whatsoever against Sephora in this respect and will not be entitled to any compensation in the event of modification or termination of the Loyalty Program.

8-SUSPENSION AND DEACTIVATION

Loyal Customers must comply with the general conditions set out in these terms and conditions, and should adopt a fair behavior towards Sephora. Accordingly, Sephora reserves the right to suspend the Loyalty Card or to permanently disable a Loyalty Card of a Loyal Customer (and therefore to cancel the benefits related to such Loyalty Card) by notifying the Loyal Customer in the event he/she abuses a Loyalty Card or otherwise harms Sephora. In such a case the Loyal Customer will not be entitled to any compensation whatsoever, particularly in the following cases:

  • In the event of fraud, attempted fraud or theft by the Loyal Customer in any Sephora Store; or
  • In the event of misuse of a Loyalty Card by the Loyal Customer; or
  • In the event of conduct by the Loyal Customer that is likely to disrupt the operation of the Loyalty Program or the operation of any Sephora Store; or
  • In the event of abnormally high number of transactions of purchases made on the same day and/or consecutive days; or
  • In case of default of payment which has not been remedied by the Loyal Customer within one (1) month following the notification from Sephora in this respect; or
  • More generally, in the event of non compliance by the Loyal Customer with these terms and conditions.

Loyal Customers who require Sephora to delete their data from Sephora’s database must surrender their Loyalty Card and will lose any loyalty points accumulated on that Loyalty Card.

 

In the event the Loyal Customer does not use their Loyalty Card for a twelve (12) month consecutive period, it will be deactivated and the accumulated points will be lost. should be “Sephora will notify the Loyal Customer that his or her card has been deactivated and if he/she does not use their Loyalty Card within thirty (30) days following such notification, the Loyalty Card will be deactivated permanently. All Loyalty Cards remain the property of Sephora and must be returned upon request.

9-LIABILITY

Sephora is not responsible for any, direct or indirect, consequences or problems in regard to the Loyalty Program. Nevertheless, Sephora will use its best efforts to ensure that the Loyal Customer can benefit from its accumulated points in case of malfunction of the Loyalty Program.

In the event the Loyal Customer loses his/her Loyalty Card, or his/her Loyalty Card has been stolen, then the Loyal Customer must inform Sephora by contacting Sephora at the following address: [email protected]

Accordingly:

  • If the Loyal Customer was holding a Sephora White Card, then he/she should create a new Sephora White Card at a Sephora Store, using their mobile number as a reference to enquire about the balance of points accumulated on their Loyalty Card. Any previously accumulated points on that lost/stolen Loyalty Card will be transferred to the new Loyalty Card.
  • If the Loyal Customer was holding a Sephora Black Card, Sephora will send the Loyal Customer a new Sephora Black Card to the postal address which was supplied by him/her to Sephora as soon as possible. Any previously accumulated points on that lost/stolen Loyalty Card will be transferred to the new Loyalty Card.
  • If the Loyal Customer was holding a Sephora Gold Card, Sephora will send the Loyal Customer a new Sephora Gold Card to the postal address which was supplied by him/her to Sephora as soon as possible. Any previously accumulated points on that lost/stolen Loyalty Card will be transferred to the new Loyalty Card.
